Town Planning

The term ‘development’ is defined in the Town and Country Planning Act, Section 55(1) as,

"the carrying out of building, engineering, mining or other operations in, on, over or under land, or the making of any material change of use in the use of any building or other land."

‘Building operation’ includes,

  • Demolition of buildings
  • Rebuilding
  • Structural alterations of or additions to buildings
  • Other operations normally undertaken by a person carrying on business as a builder.

Section 55(2) defines certain operations or uses of land which for the purposes of the Act are not taken to involve development.

  • Advice on permitted development rights
  • Planning applications involving operational development and / or material changes of use.
  • Applications for Listed Building / conservation area consent
  • Applications for consent to display advertisements
